Photography Workshop – Terms and Conditions

Event: Florence James Photography Workshop

Dates: 21st & 22nd February 2026

Location: Florence James Studio (or nominated venue)

Host: Florence James PTY LTD (ABN as registered)

These Terms and Conditions (“Terms”) govern participation in the Florence James Photography Workshop (“Workshop”) hosted by Florence James PTY LTD (“Florence James”, “we”, “us”, “our”).

By purchasing a ticket and/or attending the Workshop, you (“Attendee”, “you”, “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. Ticket Types and Access

1.1 The Workshop offers the following ticket options:

• One-Day Pass (valid for either Day 1 or Day 2 only), or
• Two-Day Pass (valid for both days).

1.2 Tickets grant access only to the specific day(s) purchased and are non-upgradable unless expressly approved in writing by Florence James.

1.3 Florence James reserves the right to refuse entry to any person who cannot provide valid proof of ticket purchase.

2. Refund Policy (Strictly No Refunds)

2.1 All tickets are strictly non-refundable under any circumstances, including but not limited to:

• Change of mind
• Illness or injury
• Travel disruptions
• Scheduling conflicts
• Failure to attend

2.2 This policy applies regardless of personal circumstances and is necessary due to limited capacity, staffing, and preparation costs.

3. Ticket Transfers

3.1 Tickets may be transferred to another individual only with a minimum of 7 days’ written notice prior to the Workshop start date.

3.2 Transfer requests must be submitted in writing to Florence James and include full details of the replacement attendee.

3.3 Florence James reserves the right to refuse transfers at its discretion.

4. General Educational Disclaimer

4.1 The Workshop is an educational experience only.

4.2 Florence James makes no guarantees regarding:

• Business success
• Income generation
• Client acquisition
• Skill mastery
• Career outcomes

4.3 You acknowledge that implementation of any techniques, advice, or strategies is done entirely at your own risk.

5. Financial Loss Exclusion

5.1 To the maximum extent permitted by law, Florence James PTY LTD excludes all liability for any financial losses, direct or indirect, suffered by Attendees as a result of:

• Attending the Workshop
• Applying or relying on Workshop content
• Business or client decisions
• Marketing strategies
• Equipment investments

5.2 This includes, without limitation, loss of income, loss of profit, business interruption, reputational damage, or opportunity cost.

6. Assumption of Risk & Physical Liability

6.1 The Workshop includes hands-on practical photography activities involving lighting equipment, electrical equipment, props, sets, and physical movement.

6.2 You voluntarily assume all risks associated with participation, including risk of:

• Personal injury
• Property damage
• Equipment malfunction
• Physical strain or accidents

6.3 Florence James is not liable for any injury, loss, or damage, including but not limited to:

• Injury to yourself or others
• Damage to personal belongings
• Damage to studio equipment
• Damage to third-party equipment

6.4 You are solely responsible for your own safety and conduct at all times.

7. Equipment Damage

7.1 Any damage caused to:

• Florence James equipment
• Venue property
• Props, sets, or assets
• Equipment of other attendees

is the full financial responsibility of the Attendee who caused the damage.

7.2 Florence James reserves the right to invoice for repair or replacement costs.

8. Proprietary Information & Intellectual Property

8.1 All content provided during the Workshop, including but not limited to:

• Teaching materials
• Techniques
• Methodologies
• Frameworks
• Workflows
• Verbal instruction
• Demonstrations

constitute proprietary intellectual property of Florence James PTY LTD.

8.2 You are strictly prohibited from:

• Filming
• Recording (audio or video)
• Photographing instructional content
• Livestreaming
• Reproducing
• Distributing
• Selling or sharing

any Workshop content in any format without express written permission from Florence James.

8.3 Breach of this clause may result in:

• Immediate removal from the Workshop
• Legal action
• Claims for damages and injunctive relief

9. Media Release & Marketing Consent

9.1 By attending the Workshop, you irrevocably consent to being:

• Photographed
• Filmed
• Recorded

9.2 You grant Florence James unrestricted, perpetual, worldwide rights to use your likeness, voice, and image for:

• Marketing
• Advertising
• Social media
• Website
• Educational materials
• Promotional campaigns

9.3 No compensation, approval rights, or royalties are payable.

10. Code of Conduct

10.1 Attendees must behave in a professional and respectful manner.

10.2 Florence James has zero tolerance for:

• Harassment
• Discrimination
• Disruptive behaviour
• Unsafe conduct
• Intoxication

10.3 Florence James reserves the right to remove any attendee without refund for inappropriate behaviour.

11. Host Cancellation or Changes

11.1 Florence James reserves the right to:

• Modify the schedule
• Change instructors
• Change venue
• Cancel the Workshop due to unforeseen circumstances

11.2 In the event of cancellation by Florence James, ticket holders may receive a credit or alternative arrangement at Florence James’ discretion.

12. Age Requirement

12.1 Attendees must be 18 years or older, unless written parental consent is provided.

13. Health & Safety

13.1 Attendees must comply with all safety instructions provided by Florence James staff.

13.2 You warrant that you are physically fit to participate.

13.3 Florence James is not responsible for pre-existing medical conditions.

14. Limitation of Liability

14.1 To the maximum extent permitted by law, Florence James’ total liability is limited to the amount paid for the ticket.

14.2 Florence James excludes all liability for:

• Indirect loss
• Consequential loss
• Special damages

15. Indemnity

15.1 You agree to indemnify and hold harmless Florence James PTY LTD, its directors, staff, contractors, and agents from any claims arising from:

• Your actions
• Your negligence
• Breach of these Terms
• Injury caused by you
• Damage caused by you

16. Force Majeure

16.1 Florence James is not liable for failure to perform due to events beyond its control, including but not limited to:

• Natural disasters
• Pandemics
• Government restrictions
• Power outages
• Acts of God

17. Governing Law

17.1 These Terms are governed by the laws of Queensland, Australia.

17.2 Any disputes shall be subject to the exclusive jurisdiction of Queensland courts.

18. Acceptance of Terms

18.1 Purchase of a ticket constitutes full legal acceptance of these Terms and Conditions.

18.2 If you do not agree with any part of these Terms, you must not purchase a ticket or attend the Workshop.

Final Legal Acceptance Statement

By purchasing a ticket and/or attending the Florence James Photography Workshop on 21st–22nd February 2026, you acknowledge that you:

• Have read and understood these Terms
• Accept all risks associated with participation
• Waive rights to claims for financial loss
• Agree to all intellectual property restrictions
• Grant full media usage rights
• Are legally bound by this agreement
